At its meeting of November 5, 2018, the City Council approved Urgency Ordinance #07-2018 (See the draft ordinance) that supplements the telecommunications facilities siting regulations in Chapter 5.32 of the Municipal code with wireless telecommunications facilities siting regulations in new Chapter 5.30. The new regulations respond to a recent order of the Federal Communications Commission (FCC) on siting of small cell wireless telecommunications facilities in the public right of way, among other things, that is scheduled to go into effect on January 14, 2019. An urgency ordinance was introduced and adopted at the meeting under Government Code Section 36937(b) to protect health, safety, and welfare.
